Maddy’s Contempt of Court Hearing and Solidarity Demonstration

This Friday, December 14th, Maddy Pfeiffer will go into the federal courthouse in Seattle, WA. A solidarity demonstration will gather at 12:30PM at 700 Stewart St. Inside, Judge Richard Jones will preside over a hearing to determine if Maddy is in contempt of court and whether to send them to the Seatac Federal Detention Center until as late as March 2014, when the grand jury ends. The prosecutor could possibly charge them with criminal contempt of court, which has no upper sentencing limit.

Maddy has been subpoenaed as part of the ongoing grand jury investigation (and resistance) into the assault on the federal court of appeals in Seattle on May Day 2012.  Early in the year, Occupy Oakland had called for a global general strike on May Day. Pacific Northwest anarchists rose to the occasion. Widespread protest by leftists was joined by a violent anti-capitalist black bloc. Targets included banks, journalists, expensive cars, the federal court house, and numerous businesses. Seattle’s self-appointed superhero even got accidentally maced by his own idiot sidekick. Seattle hadn’t suffered such wreckage in some time and damn, it felt good!

The police response to the black bloc demonstrated the inability of Seattle pigs to pick up on what an “anti-capitalist march” entails. After the bloc dissipated into the crowd, the nonprofit liberal mayor issued an emergency decree which extended police powers in downtown. But the tone for the day had been set: marches throughout the day were more confrontational than the typical Seattle passive-aggressive demeanor typically allowed. Pigs were assaulted all over downtown by people clearly unaffiliated with the black bloc.

Bruised by the rioters and embarrassed by their failure, the pigs turned to two strategies: one involved the modern surveillance machine, the other is the grand jury. SPD analyzed thousands of photos and video, releasing numerous photos of people it alleged committed various crimes against pigs and property. Some have been charged: recently, five people were charged with some combination of riot, assault, and malicious mischief. Several others have already been accused and tried.

The state is using the grand jury to allege that certain anarchists attacked the federal courthouse. While the court house was attacked in Seattle, the repression from the grand jury has fallen hardest in the form of raids and subpoenas on Portland and Olympia. An “accidentally leaked” FBI affidavit alleges that several anarchists from Portland traveled across state lines with intent to riot, damaged federal property, and conspired to commit those crimes. The combined sentence for those four charges can reach 25 years (18 USC § 2101, 18 USC § 371, 18 USC § 1361).

Maddy declined to testify at their grand jury hearing in November; their lawyer successfully argued for a continuance on the contempt of court hearing, leading to the December 14th contempt hearing. Further, they posted a transcript of the grand jury hearing. By steadfastly refusing to answer any questions, Maddy demonstrated their refusal of the state in spite of its attempt at repressing the spread of anarchy. In their transparency, Maddy showed how to maintain the confidence of all who fight the state. The grand jury has been a terrible experience for many people. Fear, uncertainty, betrayal, friends stolen away into cages… but let’s not forget why they wage this campaign: their shit got wrecked. They’re pissed because they couldn’t protect their stupid court house. For having the largest military in the world, for spending as much money securing their precious cities, for having some idiots in costumes playing superhero… they couldn’t stop the black bloc from trashing their shit.

Solidarity rally for Maddy, NEXT FRIDAY Dec. 14th @ 700 Stewart St., Seattle, WA

Maddy Pfeiffer was served a subpoena in Olympia, WA and appeared before the grand jury on Nov. 7th. At that time they were taken to a contempt hearing but received a continuance so they could prepare with their lawyer. Please come out and support them on Friday, December 14th at 12:30PM! Their hearing is at 1:30PM but let’s start early and gather for support and conversation before they have to go inside.

REMEMBER: It is likely they’ll be taken into “custody” after their hearing.

Please bring anything you can to contribute: food, coffee, umbrellas, BANNERS, FLIERS, SIGNS, megaphones, etc.

This on-screen chapter out of American Anarchist history will have a Q and A via Skype Director Terry Green to answer your questions. In a recent interview he noted that ‘The disintegration of civil liberties during times of social unrest is nothing new in America.’

This screening is a benefit to support the Pacific Northwest Grand Jury Resistors. All proceeds from this event will go towards supporting those imprisoned for refusing to cooperate with the Grand Juries that are convening in Seattle. There will be an information table and additional speakers at the screening.

Seattle. It came to light on July 25, 2012, when the FBI served subpoenas in Portland and Olympia. Earlier that morning, the pigs executed a heavily armed raid at homes of anarchists in Portland. Since that day, agents have served two other people. Feds have further attempted and failed to serve at least four others. One person has publicly communicated that they, abetted by comrades, evaded the threat of a subpoena.

The stated purpose of the subpoenas and raids is to investigate the vandalism of the federal courthouse on Fifth Avenue in downtown Seattle. However, the May Day black bloc is not the beginning or end of anarchist revolt over the past few
years. This escalation is not limited to tactics used on May
1st. Recent actions include but are not limited to arson and
sabotage targeting banks, police substations, and churches.

The grand jury may be investigating these crimes, or perhaps
it is not. The feds are dusting off long unused charges, so
perhaps they seek to establish new precedent. Regardless, the
grand jury’s purpose is broader than prosecuting those who
vandalized federal property. Grand juries intend to suppress
revolt, to instill fear in those who would manifest their hatred
for the civilized order.

Success of the pig strategy cannot yet be judged. Regardless,
comrades who defy authorities disrupt the scales of law and
justice. Furthermore, the many acts of solidarity reinforce,
escalate, and intensify the war against domination.

Brittany Kenville opposes a California grand jury

Saynothing received an email requesting support for Brittany, who was subpoenaed to testify at a grand jury investigating a 2008 Animal Liberation action in Santa Cruz. Here is her statement, and additional information.

My name is Brittany Kenville. I have been subpoenaed as a witness to the grand jury convened in San Francisco in relation to events that took place in Santa Cruz, California in 2008.  Grand juries exist to determine whether there is enough evidence for a person or persons to be indicted. Subpoenas are used to force the appearance at grand juries by anyone the prosecution feels may provide evidence in support of their case.

Grand juries operate in secrecy, and witnesses who choose to testify are not allowed to have a lawyer present when doing so. In cases like this, grand juries are used as a tool to strike fear in and intimidate activists, and also to neutralize them from action. They spread seeds of mistrust throughout activist movements, and they operate under the assumption that people in activist communities are inherently guilty by association. I am adamantly opposed to these proceedings.  I believe that they are unjust and an appalling misuse of prosecutorial power. Using grand juries to harass activist communities does not serve justice, it is simply a means of political repression.

I have been working with an attorney, and I plan on exercising every right that I have in response to my subpoena. I have the complete, unfaltering support of my family, my friends and my fellow activists. I encourage anyone else who is subpoenaed to reach out, seek counsel, do research, and learn your rights in these proceedings. I hope everyone reading this will learn more about the grand jury system and join me in standing up against its use as a tool of harassment.
